Welcome to ZoloNet. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and ZoloNet Limited, a company registered in Hong Kong ("ZoloNet", "Company", "we", "us", "our"). These Terms govern your access to and use of the ZoloNet platform, including our website at zolonet.com, our web application at app.zolonet.com, all related APIs, integrations, tools, and services (collectively, the "Service" or "Platform").
By creating an account, accessing the Platform, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree to these Terms, you must not access or use the Service.
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account and use the Service. By using ZoloNet, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement. If you are using the Service on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
To access most features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password and any other credentials used to access your account. You must not share your account credentials with any third party.
You are solely responsible for all activities that occur under your account. You agree to immediately notify ZoloNet of any unauthorized use of your account or any other breach of security. ZoloNet will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.
ZoloNet operates on a multi-tenant, workspace-based architecture. Each account may be associated with one or more workspaces. Workspace owners and administrators are responsible for managing user access, permissions, and data within their workspaces. You agree that data within a workspace is accessible to all authorized members of that workspace.
ZoloNet is a comprehensive, AI-powered digital marketing and business management platform. The Service includes, but is not limited to, the following features and modules:
The Platform integrates with numerous third-party services to provide its functionality. These integrations include but are not limited to:
Your use of third-party integrations is also subject to the respective terms of service and privacy policies of those third-party providers. ZoloNet is not responsible for the practices, policies, or content of any third-party service.
When you connect your social media accounts to ZoloNet, you authorize us to access and interact with your accounts through the official APIs provided by each platform. This access is used solely to provide the features you have requested, such as publishing content, retrieving analytics, managing advertising campaigns, and monitoring engagement. You may revoke access to any connected social media account at any time through the Integrations page in your ZoloNet dashboard or through the respective platform's settings.
ZoloNet integrates with TikTok through TikTok's official API. When you connect your TikTok account, you authorize ZoloNet to:
ZoloNet does not store your TikTok login credentials. Authentication is handled through TikTok's OAuth 2.0 protocol, and access tokens are stored securely and encrypted. You can disconnect your TikTok account at any time, which will immediately revoke ZoloNet's access. ZoloNet complies with TikTok's Developer Terms of Service, Platform Terms, and Data Portability API Terms. We do not sell TikTok user data to third parties. Data obtained from TikTok APIs is used exclusively to provide the services you have requested within the ZoloNet platform.
When you connect your Facebook or Instagram accounts, you authorize ZoloNet to access your pages, business accounts, and ad accounts through Meta's Graph API. This includes publishing posts, retrieving insights, managing ads, and accessing page/account analytics. Your use of these features is subject to Meta's Platform Terms and Policies.
LinkedIn integration allows ZoloNet to post content to your LinkedIn profile or company pages, retrieve analytics, and manage LinkedIn advertising campaigns through LinkedIn's Marketing API. Your use is subject to LinkedIn's API Terms of Use.
YouTube integration enables video publishing, analytics retrieval, and channel management through YouTube's Data API v3. Your use is subject to YouTube's Terms of Service and Google's API Services Terms.
Pinterest integration allows pin creation, board management, and analytics retrieval through Pinterest's API v5. Your use is subject to Pinterest's Developer Terms and API Terms.
For all social media integrations, ZoloNet adheres to the following principles:
You retain all ownership rights to the content you create, upload, publish, or transmit through the Platform ("User Content"). By using the Service, you grant ZoloNet a limited, non-exclusive, worldwide, royalty-free license to use, store, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your User Content or your account.
You are solely responsible for all User Content that you create, upload, publish, or distribute through the Service, including content published to third-party platforms through our integrations. You represent and warrant that you own or have the necessary rights and that your content does not violate any third party's rights or applicable laws.
The Platform includes AI-powered tools that can generate text, images, video, audio, and other content. AI-generated content may not always be accurate or suitable for your purpose. You are responsible for reviewing all AI-generated content before use. ZoloNet does not claim ownership of AI-generated content created through your use of the Platform.
ZoloNet processes your data in accordance with our Privacy Policy. Where applicable, we act as a data processor on your behalf with respect to customer data you manage through the Platform (such as CRM contacts and email subscribers), and you act as the data controller.
You agree not to use the Service to:
ZoloNet reserves the right to investigate and take appropriate action against violators, including removing content, suspending or terminating accounts, and reporting to law enforcement.
If you use ZoloNet's email marketing features, you must comply with all applicable anti-spam laws (CAN-SPAM, GDPR, CASL). This includes obtaining proper consent, providing unsubscribe mechanisms, including your business address, using honest subject lines, and honoring opt-out requests within 10 business days.
Certain features require payment. All fees are in USD unless otherwise specified. Prices may change with 30 days' notice.
Payments are processed through Airwallex and/or Stripe in accordance with PCI-DSS compliance standards. You authorize us to charge fees to your designated payment method.
Paid subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
Refunds are handled per our Refund Policy. We offer 14-day refunds for annual plans. Monthly subscriptions are generally non-refundable for the current period.
Free tiers or trials may have limited functionality, usage caps, or time restrictions. ZoloNet may modify or discontinue free offerings at any time.
The Service and all materials are the property of ZoloNet Limited or its licensors, protected by copyright, trademark, patent, and other IP laws. The ZoloNet name, logo, and all related marks are trademarks of ZoloNet Limited.
Subject to compliance with these Terms, ZoloNet grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
If you provide suggestions or feedback, you acknowledge that we may freely use such feedback without obligation to you.
Our data practices are described in our Privacy Policy. By using the Service, you consent to those practices.
We implement industry-standard security measures including TLS/SSL encryption, OAuth 2.0 authentication, access controls, and regular security audits. No method of electronic storage is 100% secure.
We retain your data while your account is active. Upon deletion request, personal data is deleted within 30 days, except where retention is required by law.
ZoloNet Limited is based in Hong Kong. Your data may be processed in Hong Kong or other jurisdictions where our providers operate. We ensure appropriate safeguards for all transfers.
For EEA users, we comply with GDPR. You have rights to access, rectify, erase, restrict processing, and port your data. Contact marketing@zolonet.com to exercise these rights.
API access is subject to these Terms and additional rate limits. API keys must be kept secure and not shared publicly.
Exceeding rate limits may result in throttling or suspension. Repeated violations may result in permanent revocation.
You are responsible for the security of receiving endpoints and data handling for webhooks and integrations.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ZOLONET IS NOT RESPONSIBLE FOR THE AVAILABILITY OR RELIABILITY OF THIRD-PARTY SERVICES. CHANGES TO THIRD-PARTY APIS MAY AFFECT FEATURE AVAILABILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZOLONET SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. ZOLONET'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) US$100.
You agree to indemnify and hold harmless ZoloNet from claims arising from your use of the Service, your content, your violations of these Terms, or content you publish through the Platform.
You may terminate your account at any time via marketing@zolonet.com or account settings. You remain responsible for fees incurred prior to termination.
We may suspend or terminate your account for violations, fraud, non-payment, inactivity, law enforcement requests, or security issues.
Upon termination, all licenses cease. Account data may be deleted within 30 days unless required by law. You may request a data export before termination. Provisions regarding IP, disclaimers, liability, and indemnification survive termination.
ZoloNet may modify, suspend, or discontinue any aspect of the Service at any time. We will make reasonable efforts to notify you of significant changes.
We may modify these Terms at any time by posting updates and changing the "Last Updated" date. Continued use constitutes acceptance. If you disagree, stop using the Service.
These Terms are governed by Hong Kong law, without regard to conflict of law principles.
Disputes shall first be resolved through good-faith negotiation (30 days), then binding arbitration in Hong Kong under HKIAC rules in English.
DISPUTES WILL BE RESOLVED INDIVIDUALLY, NOT AS A CLASS ACTION. EACH PARTY WAIVES JURY TRIAL RIGHTS.
These Terms, the Privacy Policy, and Refund Policy constitute the entire agreement and supersede all prior agreements.
If any provision is found unenforceable, it shall be limited to the minimum extent necessary; remaining provisions remain in full force.
Failure to enforce any provision does not constitute a waiver. Waivers must be in writing.
You may not assign these Terms without our consent. ZoloNet may assign without restriction.
ZoloNet is not liable for failures due to causes beyond reasonable control (natural disasters, war, pandemics, power failures, internet disruptions, third-party outages).
